Myles, William, Ulrika, and James will engage in a lively panel interview on Navigating HTS and AD CVD Compliance, with a Q&A planned after the presentations.

Speakers:

Myles Getlan is a Chambers-ranked international trade partner at Cassidy Levy Kent (USA) LLP.  Mr. Getlan’s practice focuses on international trade and investment disputes, including antidumping, countervailing duty, and safeguard cases, and on import and export compliance and enforcement matters.  Mr. Getlan also provides clients with strategic advice in relation to U.S. trade policy and serves as Co-Chair of the Trade Policy Committee of the American Association of Exporters and Importers (AAEI).  In both trade regulation and litigation, Mr. Getlan has represented multinational corporations and trade associations in a variety of industries, including agriculture, consumer products, metals, energy, chemicals, pharmaceuticals, electronics, and wood products.  Before entering private practice, Mr. Getlan served in the Office of the Chief Counsel for Import Administration at the U.S. Department of Commerce and also held positions at the Office of the US Trade Representative and the Trade Subcommittee of the Ways and Means Committee, US House of Representatives.

Bill Baldwin has been a partner at CLK since shortly after the firm’s inception in 2011.  His practice focuses on matters involving trade regulation of imports. His clients have included both domestic and international companies affected by U.S. trade laws.  His regulatory practice covers a wide range of import-related issues, including customs classification, valuation, country of origin, marking and labeling, NAFTA and other free trade agreements, antidumping and countervailing duties, Section 201, 232 and 301 measures as well as FTZs, corporate compliance programs, and cargo security.  He has advised companies from virtually every industry sector over the past 25-plus years.

His administrative practice involves representing clients before U.S. Government agencies including U.S. Customs and Border Protection, the U.S. Department of Commerce, the U.S. International Trade Commission, the U.S. Food and Drug Administration, the Environmental Protection Agency, and U.S. Consumer Product Safety Commission.

His litigation experience ranges from cases involving typical customs issues to complex constitutional challenges of laws and regulations relating to international trade. His appellate experience involves appearances before the U.S. Court of International Trade and the U.S. Court of Appeals for the Federal Circuit.

Ulrika Swanson is a partner in Cassidy Levy Kent’s Washington, DC office, where her practice focuses on export controls and economic sanctions.  As outside counsel to domestic and international companies in a wide range of industries, Ms. Swanson provides advice on regulatory compliance, and represents clients before the Office of Foreign Assets Control, the Directorate of Defense Trade Controls, and the Bureau of Industry and Security.  Ms. Swanson also assists clients in trade remedy actions before the U.S. International Trade Commission and the U.S. Department of Commerce, as well as clients involved in proceedings before U.S. Customs and Border Protection.

Prior to joining Cassidy Levy Kent, Ms. Swanson spent over a decade working in the international trade and investment field.  She held a senior position in a prominent Washington-based public policy research organization, where her work included studies on cross-border trade issues, U.S.-China economic relations, U.S. economic issues, environmental standards under the WTO system, and free trade agreements. While there she also provided trade-related strategy advice to foreign governments. Ms. Swanson also previously served as a legal consultant to an international arbitration law firm, where she advised on issues relating to cross-border trade and investment and assisted clients involved in international commercial disputes.

James Kim is an international trade attorney at ArentFox Schiff with over a decade of experience across public and private sectors. He advises clients in industries such as electronics, solar, automotive, e-commerce, and biotech on navigating regulatory issues, minimizing duty exposure, and defending against government inquiries and penalties. James also represents clients in litigation before the Court of International Trade.

His practice covers a wide range of customs and trade issues, including tariff classification, valuation, origin rules, special tariffs (Section 301, 232, and 201), duty drawback, AD/CVD enforcement, and export controls and sanctions. He also advises on compliance with anti-forced labor laws, Inflation Reduction Act (IRA) clean energy credits, Made in USA labeling rules, partner government agency regulations, and Committee on Foreign Investment in the United States (CFIUS) reviews. James frequently writes and speaks on trade law topics, offering practical solutions for complex legal challenges faced by companies operating in the global supply chain. As founder and editor-in-chief of his firm’s trade newsletter, he keeps clients informed on key developments.

Prior to joining ArentFox Schiff, James served as an attorney-advisor at U.S. Customs and Border Protection (CBP), where he played a leading role in the implementation of the U.S.-Mexico-Canada Agreement (USMCA). While at CBP, he also worked in the Regulations and Rulings division, drafting binding rulings and providing guidance on a range of trade and customs matters.

James lives in San Francisco with his wife and son and is a member of the Virginia State Bar. James holds his undergraduate and law degrees from institutions in the Washington, D.C., area, where he was born and raised.
